JUST IN: Federal High Court stops implementation of increased electricity tariff in Kano

The Federal High Court in Kano has issued an interim order halting the National Electricity Regulatory Commission (NERC) and the Kano Electricity Distribution Company (KEDCO) from implementing a new increased electricity tariff for Band A consumers in the DisCo’s franchise area.

NERC’s directive to charge Band A consumers higher tariffs sparked criticism, especially amidst ongoing electricity supply challenges across the country.

In response to concerns raised, Justice A.M. Liman granted the interim order following an ex-parte motion brought by A.B. Mahmoud, SAN, representing several companies, including Super Sack Company Limited, BBY Sacks Limited, Mama Sannu Industries Limited, Dala Foods Nigeria Limited, Tofa Textile Limited, and the Manufacturers Association of Nigeria Limited (MAN).

The ruling restrains NERC and KEDCO from implementing the tariff increase slated for this month until a hearing and determination of the motion on notice.

Additionally, the court order prohibited the defendants from intimidating or threatening to disconnect the electricity supply for non-acceptance of the new tariff by the Applicants.
