BREAKING: Appeal Court Overturns High Court Ruling on Kano LG Election

The Court of Appeal sitting in Abuja has nullified a previous ruling by the Federal High Court in Kano, effectively affirming the legitimacy of the local government elections conducted in October 2024 by the Kano State Government.

In a judgment delivered on Friday, Justice Oyewumi held that the Federal High Court lacked the jurisdiction to hear the case brought before it by the All Progressives Congress (APC), which sought to halt the elections.

The APC had argued that the Chairman of the Kano State Independent Electoral Commission (KANSIEC), Prof. Sani Malumfashi, along with several commissioners, were members of the ruling New Nigeria People’s Party (NNPP), thereby compromising the integrity of the polls. Acting on these claims, Justice A.M. Liman of the Federal High Court had ruled in favour of the APC and ordered the suspension of the elections.

Despite the court order, the local government polls went ahead as scheduled.

In its decision, the appellate court set aside the earlier ruling, declaring the lower court’s intervention as a clear overreach of its constitutional powers. The court maintained that matters concerning local government elections fall outside the purview of the Federal High Court.
