The Abuja Division of the Court of Appeal has ordered a fresh hearing in the dispute between the Emir Muhammad Sanusi and Ado Bayero.
Messers Sanusi and Bayero have been engaged in a legal battle over the Kano Emirate which led to the depose of the later.
A 3-member panel led by Justice Mohammed Mustapha had annulled a judgement by a lower court on who should remain the Emir of the council.
However, the Court of Appeal in its ruling held that the appellants’ right to a fair hearing was breached in the judgement by the Kano State High Court.
According to the Appellate Court, facts available to the court show that Bayero did not enjoy fair hearing in the matter. It said the lower court unfairly proceeded with hearing on the matter without serving a hearing notice to Bayero.
The judge said the lower court failed to give Bayero an opportunity to present his case before judgement was delivered against him.
Further ordering that the case file be returned to the Chief Judge of the Kano State High Court, the Court of Appeal described the judgement as a travesty of justice.
