A Federal Capital Territory (FCT) High Court has struck out the application presented before it by a former governor of Kogi State, Yahaya Bello.
The court presided over by Justice Maryann struck out Bello’s application on the ground that it was filed when the ex-governor was yet to be taken into custody of the Economic and Financial Crimes Commission (EFCC).
According to the judge, an applicant cannot be granted bail when he or she is not yet in custody of any law enforcement agency, like the Police, the EFCC or DSS.
Bello’s lawyers had filed a bail application on his bahalf on November 22, before he was detained by the EFCC.
The former governor was, however, taken into custody by the EFCC on November 26 (four days after he honoured the commission’s invitation and was subsequently detained).
He was then arraigned before the court on November 27, by the anti-graft agency.
