Popular activist and Lawyer, Dele Farotimi has been remanded in Prison Custody after being arraigned by the Police at a Magistrate Court in Ado-Ekiti, the capital of Ekiti State on Wednesday.
Farotimi was arraigned over allegations of defaming the character of renowned legal luminary, Aare Afe Babalola, SAN. POLITICS NIGERIA learned that the case originated from claims in Farotimi’s new book, Nigeria and Its Criminal Justice System, where he allegedly accused Aare Afe Babalola of judicial corruption, including procuring Supreme Court judgments.
Prosecutors argue that these allegations exposed Babalola to public ridicule, contempt, and harm to his professional reputation.
Court Proceedings
Farotimi, facing a 16-count charge of defamation, pleaded not guilty. Prosecutor Samson Osun requested the court to remand the defendant in custody, citing the need for further investigations and public safety concerns. However, defense counsel Dayo Akeredolu opposed the remand, arguing that defamation is a bailable offense and highlighting Farotimi’s status as a public figure unlikely to evade trial. He emphasized the presumption of innocence under Nigerian law.
Magistrate’s Ruling
Presiding Magistrate Abayomi Adeosun ruled in favor of the prosecution, ordering Farotimi’s remand in prison custody. The court adjourned the hearing to December 10, 2024.
