The Edo State House of Assembly has appealed the judgment by Justice J. K. Omotosho of the Federal High Court, Abuja, which nullified the impeachment of the state’s former deputy governor, Philip Shaibu.
In response to the ruling, the Assembly has also filed a stay of execution on the judgment pending the appeal.
Earlier today, Justice Omotosho voided Shaibu’s impeachment, ruling that the state House of Assembly failed to comply with due process in removing him from office.
Consequently, the court ordered Shaibu’s reinstatement and set aside the appointment of the new deputy governor who had replaced him.
The Edo state House of Assembly impeached Shaibu in April ending a long-drawn drama between him and Governor Godwin Obaseki.
Shaibu’s impeachment followed the adoption of the report of a seven-man committee set up by the chief judge of Edo State Justice Daniel Okungbowa to investigate allegations of misconduct against the deputy governor.
Eighteen out of 19 members present at plenary voted for the impeachment of Shaibu while one abstained from the head count and voting process.
