How Buhari can release Kanu without interfering with Judiciary – Ozekhome

Mike Ozekhome (SAN), lead lawyer to Nnamdi Kanu, detained leader of the outlawed Indigenous People of Biafra (IPOB) has said President Muhammadu Buhari can trigger the release of his client by adopting the constitutional power vested on the Attorney-General of the Federation (AGF) under Section 174 in respect of the prosecution of criminal matters.

POLITICS NIGERIA reports that Ozekhome made this known while delivering a lecture titled, “Nigeria in the Throes of insecurity towards 2023: Any Panacea,” during the 11th Zik Lecture Series, organised by the Faculty of Social Sciences, Nnamdi Azikiwe University, Awka, Anambra State.

Ozekhome said that Kanu’s freedom will bring peace to the southeast region ahead of the 2023 election.

“We are not saying you should subvert the judicial process by releasing Nnamdi Kanu. You can instruct your Attorney-General who has the powers under section 174 of the constitution to enter a nolle prosequi, a total discontinuance of the whole case,” Ozekhome said.

“What will bring peace to the southeast towards 2023 is not the continued detention of Nnamdi Kanu, who has become a metaphor for the Igbo struggle, it is rather his immediate release to his people and they will be happy.”
