Justice Binta Nyako of the Federal High Court has sent an impromptu notice demanding that the leader of the Indigenous People of Biafra, Nnamdi Kanu appear before her court.
The judge who had earlier recused herself from the trial of the IPOB leader ordered that Kanu appear in court on Monday, February 10.
Aloy Ejimakor, Kanu’s counsel after a visiting routine by the legal team and the IPOB leader’s family said they would be appearing in court on the said date.
“Our discussions centered on the surprising Notice we received to appear in court with Mazi Nnamdi Kanu on Monday, 10th February 2025. We shall appear with a bated breath,” Ejimakor stated.
The counsel had earlier filed a application for the transfer of his client’s case to any Federal Court Division in the South-East states.
This follows an order by Justice Nyako to recuse herself from the case.
The lawyer said, “We are reliably informed that, following the said recusal, Justice Murtala-Nyako promptly sent the case file to Your Lordship for the purpose of reassigning it to another Judge of the same Abuja division of the Federal High Court.”
He, however, noted that the chief judge was not able to reassign the matter to any other judge in the Abuja division because no judge agreed to take on the matter.
He added that the chief judge has also returned the case file to Nyako, which the lawyer said his team would be protesting.
“Given that no other judge in the Abuja division is willing to take the case, the only option left is to transfer the case to any division of the Federal High Court in the Southeast geopolitical zone, especially since the offenses are alleged to have had impact in Southeast (and not Abuja), which thus gives the Southeast divisions a far superior jurisdiction than any other division, including Abuja,” Ejimakor added.
