President Bola Tinubu, along with other government officials, has been taken to court over the recent declaration of emergency rule in Rivers State.
The lawsuit filed at the Federal High Court in Abuja, is challenging the president’s decision to suspend the state’s elected leaders and appoint a sole administrator.
The legal action follows President Tinubu’s suspension of Governor Siminalayi Fubara, Deputy Governor Ngozi Odu, and members of the Rivers State House of Assembly on Tuesday. In their place, he appointed retired Chief of Naval Staff, Vice Admiral Ibok-Ete Ekwe Ibas, as the state’s sole administrator.
Lawmakers in both chambers of the National Assembly ratified the emergency rule on Thursday.
The case was filed by lawyer Daniel Wariboko, representing himself and other registered voters in Rivers State. It raises several legal questions, including whether a dispute between a governor and the state assembly justifies declaring a state of emergency under Nigeria’s Constitution, whether the president has the power to suspend an elected government in any state, whether the appointment of a sole administrator is legal when an elected governor and legislators are still in office, whether the emergency rule declared on March 18, 2025, is unconstitutional, whether the suspension of elected officials violates the rights of Rivers State citizens under the African Charter on Human and Peoples’ Rights, and whether the National Assembly had the authority to approve the president’s suspension of the state government.
Wariboko and the other plaintiffs are asking the court to declare the emergency rule in Rivers State unconstitutional, null, and void, reinstate Governor Fubara, his deputy, and the state legislators, stop the president from appointing a sole administrator for any state, prevent the National Assembly from approving such suspensions in the future, and restore democracy in Rivers State.
Its all a game it’s a mind game
Think about this Rivers is the only state without APC sovereignty if they want to take it up it has to start from the inside the fight between wike and fubara is probably like I suspected there is something else to it I don’t need to explain it to people that would understand already. He drooped a military personnel on a position that is even hot for fubara to handle the guy is just going to be a figurehead the main changes that will happen are going to be done by the people that came with him as advisors or those hat already defected to another party this is so clear why can’t anyone see this. Tinubu did that because he knew for sure there wasn’t going to any opposition and if there was it would die down as fast as it came up we could see that from that Honourable OBI from umuiaha when they had that meeting it makes so much sense now because Tinubu knows nothing could ever happen you can’t use force to do anything like that everyone would know it was you and retaliate but if you do it in plain site but legally people wouldn’t have a reason to talk that’s what he did I’m sure that voice vote exist somewhere in our constitution we just never used it once and I’m sure that putting a military personnel on a government position at any time by other of the headof state also exist in our constitution but we never used it because we never had a reason to but now there is a reason like someone I knew said ‘tinubu is one of he most dangerous men in Nigeria’ his old age is a way to make people underestimate him all this illnesses are for show people like that have top medical doctors and have access to treatments and drugs we have never heard of.
