The Supreme Court has dismissed the application of the All Progressives Congress (APC) in Zamfara seeking to review the judgement on state governorship election.
The apex court, led by the Chief Justice of Nigeria (CJN), Justice Ibrahim Muhammad, made this known on Friday in a lead judgment delivered by Justice Inyang Okoro.
In a majority ruling on Friday, four members of a five-member panel dismissed the application on the grounds that it was without merit.
Justice Okoro held that the application was a gross abuse of the process of the court, frivolous and grossly vexatious, thereby awarded a cost of N2million to be paid to the respondents 1 to 140.
The apex court also held that it lacks the jurisdiction to entertain an application seeking a review of its own judgment as the finality of the judgment of the supreme court is sealed and cannot be reviewed under any guise.
In a dissenting judgement, Justice Centus Nweze disagrees with the other members of the panel dismissing the application of the APC.
He insists that it is better to admit an error instead of justifying an error that fails to represent justice.
Justice Nweze noted that the Supreme Court has reviewed its decision before and should be bold enough to admit where there are errors that ought to be rectified.
He dismissed the objection raised by the respondents, upheld the application and granted the prayers sought.
